Work and Study in the UK
UK Tier 1 Work Visas
International entrepreneurs or investors are “high-value migrants”, who intend to come to the UK in order to invest or start up a business and they are targeted by the Tier 1 Visas. The following are the subcategories of Tier 1 Visas:
- Tier 1 (General): This category, which was intended for highly qualified employees, has been closed. Applicants may apply for any of the other visas in this tier.
- Tier 1 (Exceptional Talent): This award is given to individuals who work in a particular field (such as science, medicine, engineering, or the arts) and are globally recognised as thought leaders in their field. The minimum score is 75 points.
- Tier 1 (Entrepreneur): This entry point for immigrants is now closed. It used to be for people who wanted to start a company in the United Kingdom. Individuals who already have this permit can extend it until April 5, 2023, while new applicants can now apply for the Innovator path. This was launched in 2019 and needs a £50,000 initial investment.
- Tier 1 (Investor): To be eligible for this visa, you must have at least £2,000,000 available to invest in the UK.
- Tier 1 (Graduate Entrepreneur): This path is now closed, and the Start-Up Visa has taken its place. This is for people who want to start their first company in the United Kingdom. Applicants must show their high potential despite the lack of a minimum investment requirement.
UK Tier 2 Work Visas
Applicants who have been offered a professional job (such as accountancy, IT, or healthcare) by a UK-based sponsor are eligible for this category of UK visas. A certificate of sponsorship must be held or requested by the employer. In addition, the job must be on the Tier 2 Shortage Occupations List. Tier 2 candidates must achieve a score of at least 70 on their evaluation exam.
The four different visa categories under Tier 2 in the United Kingdom are as follows:
- Tier 2 General: This visa is for foreign workers who have been offered a job in a position that is either on the Shortage Occupations List or for which there are insufficient qualified workers in the domestic labor market.
- Tier 2 (Intra-Company Transfer – ITC): Current workers who work abroad but need to move to a UK branch of their business are eligible for this type of UK visa. This permit is open to long-term employees as well as new graduate trainees.
- Tier 2 (Sportsperson): This category is only open to internationally recognised athletes and trained coaches whose position is recognised or approved by their sport’s governing body.
- Tier 2 (Minister of Religion): This permit is intended for religious employees and missionaries who need to serve in a faith group in the United Kingdom.

Settle in the UK
Biometric Residence Permit (BRP)
If you meet the following criteria, you will automatically be issued a Biometric Residence Permit:
- Permission to remain in the UK for more than 6 months is granted
- Applied to extend your current visa for at least another 6 months.
- As a UK national, you have applied to settle in the country.
- Request that your existing permit be transferred to a new passport.
Right of Abode
Dual nationals may stamp their international passports with a Right of Abode stamp, allowing them to freely enter the UK. You can also apply if you are a member of the following groups:
- A Commonwealth citizen whose parents were both born in the United Kingdom.
- On or before January 1, 1983, a Commonwealth woman married to a British national.
Indefinite Leave to Remain in the UK (ILR)
In general, you must have lived in the UK for at least five years before applying for Indefinite Leave to Remain. Applicants in the UK on various visas, on the other hand, may be able to demand settled status before, or even after, this time period. Spouse Visa holders, for example, would be eligible for ILR after just two years.
You will no longer be subject to any immigration-related limitations once you have settled in the UK. You will be able to visit, work, and study in the UK without needing to apply for a visa, as well as travel abroad and return to the UK.
On the other hand, if you stay overseas for longer than two years, your permanent resident status will be revoked.
Before you may apply for British citizenship, you must have Indefinite Leave to Remain in the United Kingdom.
Citizenship and Naturalisation
After five years of lawful residency in the UK, or three years if married to a British national, you will naturalise as a British citizen.
After a further 12-month period, you will be qualified for British nationality if you have Indefinite Leave to Remain in the UK. You must also meet relevant conditions before submitting your request to naturalise as a UK citizen, such as:
- Demonstrate that you have a good command of the English language.
- Pass the Life in the UK Test to demonstrate your loyalty to British customs.
- Be of good character, which means you do not have a serious criminal record or have resided in the UK without violating any immigration rules.
- During your qualifying time, you must not have spent more than 450 days outside the UK.
Since British naturalization is a complicated procedure that necessitates the submission of a substantial portfolio of documentation and evidence to the UKVI, it is always recommended to obtain legal advice from a qualified immigration solicitor.
