Do I need a Visa to enter the UK?

Depending on the circumstances, a visa application may be required in order to visit and enter the United Kingdom.

Each visa category has its own set of eligibility requirements, and in some cases, applicants must have a UK-based sponsor.

You must also have an appropriate portfolio of documents to support your case and show that you qualify for your desired visa.

Join your Family and visit the UK

If you want to spend more than 6 months in the UK with family or spouses who are British nationals or permanent residents, you must apply for a Family or Partner Visa.

    Family Visas

You may apply for one of the following Family Visas to join your family in the UK:

    • Parent of a British citizen or permanent resident: If your child is under the age of 18 and lives independently in the UK, you may apply for this permit.
    • A British national or a permanent resident’s children: If your child is under the age of 18 and lives independently in the United Kingdom, you may apply for this permit.
    • Adults coming to be cared for by a relative: Your designated relative must be a British national or settled individual to be considered. Furthermore, this individual must be able to help, accommodate, and care for you without relying on government assistance.
    • UK Ancestry Visa: Many who are Commonwealth citizens or can claim that one of their ancestors was a British national are eligible to apply for a visa.
    • EEA Family Permit: This visa is for people who live outside of the European Economic Area (EEA) and want to visit their family in the United Kingdom within six months of applying.

    Partner Visas

Those who are engaged to, married to, or in a civil partnership with a British national or settled person are eligible for a Partners Visa. Depending on your condition and whether or not you wish to include your dependents in your application, you may be required to meet additional financial and eligibility requirements.

    • Spouse Visa: With a Marriage Visa, you can stay in the UK with your partner for up to 30 months. You must demonstrate that your relationship is sincere and that you meet the financial conditions to be considered.
    • Fiance Visa: The fiance visa is for someone who plans to marry in the United Kingdom within six months of filing their application. However, if anyone does not meet this necessary condition, they will be deported from the UK at the end of their allowed duration of stay.
    • Civil Partnership Visa: In England and Wales, same-sex couples may legally join a civil union or convert an existing one to marriage. You must not be married or related to someone who is already married to be considered. Most notably, in England and Wales, opposite-sex couples are currently unable to enter a civil union. Scotland and Northern Ireland may have different laws.

Work and Study in the UK

In general, if you want to work or study in the UK, you’ll need a UK-based employer or educational institution to support your PBS visa application. To show their eligibility under the UK Visa scheme, applicants must pass an assessment exam.

      UK Tier 1 Work Visas

International entrepreneurs or investors are “high-value migrants”, who intend to come to the UK in order to invest or start up a business and they are targeted by the Tier 1 Visas. The following are the subcategories of Tier 1 Visas:

      • Tier 1 (General): This category, which was intended for highly qualified employees, has been closed. Applicants may apply for any of the other visas in this tier.
      • Tier 1 (Exceptional Talent): This award is given to individuals who work in a particular field (such as science, medicine, engineering, or the arts) and are globally recognised as thought leaders in their field. The minimum score is 75 points.
      • Tier 1 (Entrepreneur): This entry point for immigrants is now closed. It used to be for people who wanted to start a company in the United Kingdom. Individuals who already have this permit can extend it until April 5, 2023, while new applicants can now apply for the Innovator path. This was launched in 2019 and needs a £50,000 initial investment.
      • Tier 1 (Investor): To be eligible for this visa, you must have at least £2,000,000 available to invest in the UK.
      • Tier 1 (Graduate Entrepreneur): This path is now closed, and the Start-Up Visa has taken its place. This is for people who want to start their first company in the United Kingdom. Applicants must show their high potential despite the lack of a minimum investment requirement.

      UK Tier 2 Work Visas

Applicants who have been offered a professional job (such as accountancy, IT, or healthcare) by a UK-based sponsor are eligible for this category of UK visas. A certificate of sponsorship must be held or requested by the employer. In addition, the job must be on the Tier 2 Shortage Occupations List. Tier 2 candidates must achieve a score of at least 70 on their evaluation exam.

The four different visa categories under Tier 2 in the United Kingdom are as follows:

      • Tier 2 General: This visa is for foreign workers who have been offered a job in a position that is either on the Shortage Occupations List or for which there are insufficient qualified workers in the domestic labor market.
      • Tier 2 (Intra-Company Transfer – ITC): Current workers who work abroad but need to move to a UK branch of their business are eligible for this type of UK visa. This permit is open to long-term employees as well as new graduate trainees.
      • Tier 2 (Sportsperson): This category is only open to internationally recognised athletes and trained coaches whose position is recognised or approved by their sport’s governing body.
      • Tier 2 (Minister of Religion): This permit is intended for religious employees and missionaries who need to serve in a faith group in the United Kingdom.

Study in the UK: Student UK Visas

Student visas enable foreign students to study at a school, college, or university in the United Kingdom. Applicants must have a Confirmation of Acceptance of Studies (CAS) from a UK educational institution to be eligible.

      • Student Visa: Students who are 18 years old or above and have been offered a position at a UK educational establishment that holds a valid sponsorship license may apply for this visa.
      • Child Student Visa: Non-UK students under the age of 18 may apply for this permit. Applicants aged 16 and above may be permitted to work up to 10 hours a week.
      • Short-Term Study Visa: If you want to visit the UK for a limited time and have been given a position on a short-term course, such as a training course or an English language course, you can apply for this visa that has validity for 6 to 11 months.

      Temporary Worker Visas

Temporary Work Visas are appropriate for those who wish to visit the UK for a short period of time and do not plan to stay.

      • Tier 5 Visa (Charity Worker): This permit is for employees who have been offered an unpaid or volunteer employment.
      • Tier 5 Visa (Creative and Sportspersons): This visa is only available to highly qualified creative professionals or athletes who have been offered a position in the United Kingdom.
      • Tier 5 Visa (International Agreement): Staff with a job offer that is protected by international law, such as diplomatic or embassy employees, are eligible for this visa.
      • Youth Mobility Scheme Visa: This visa allows foreign workers aged 18 to 30 who are nationals of one of the Youth Mobility Scheme countries to live and work in the UK for up to two years.

          Settle in the UK

Depending on your present situation, you may be qualified to live in the United Kingdom after a certain period of time as a lawful citizen. Obtaining British citizenship is the final step in the immigration process in the UK..

          Biometric Residence Permit (BRP)

If you meet the following criteria, you will automatically be issued a Biometric Residence Permit:

          • Permission to remain in the UK for more than 6 months is granted
          • Applied to extend your current visa for at least another 6 months.
          • As a UK national, you have applied to settle in the country.
          • Request that your existing permit be transferred to a new passport.

          Right of Abode

Dual nationals may stamp their international passports with a Right of Abode stamp, allowing them to freely enter the UK. You can also apply if you are a member of the following groups:

          • A Commonwealth citizen whose parents were both born in the United Kingdom.
          • On or before January 1, 1983, a Commonwealth woman married to a British national.

Indefinite Leave to Remain in the UK (ILR)

In general, you must have lived in the UK for at least five years before applying for Indefinite Leave to Remain. Applicants in the UK on various visas, on the other hand, may be able to demand settled status before, or even after, this time period. Spouse Visa holders, for example, would be eligible for ILR after just two years.

You will no longer be subject to any immigration-related limitations once you have settled in the UK. You will be able to visit, work, and study in the UK without needing to apply for a visa, as well as travel abroad and return to the UK.

On the other hand, if you stay overseas for longer than two years, your permanent resident status will be revoked.

Before you may apply for British citizenship, you must have Indefinite Leave to Remain in the United Kingdom.

          Citizenship and Naturalisation

After five years of lawful residency in the UK, or three years if married to a British national, you will naturalise as a British citizen.

After a further 12-month period, you will be qualified for British nationality if you have Indefinite Leave to Remain in the UK. You must also meet relevant conditions before submitting your request to naturalise as a UK citizen, such as:

          • Demonstrate that you have a good command of the English language.
          • Pass the Life in the UK Test to demonstrate your loyalty to British customs.
          • Be of good character, which means you do not have a serious criminal record or have resided in the UK without violating any immigration rules.
          • During your qualifying time, you must not have spent more than 450 days outside the UK.

Since British naturalization is a complicated procedure that necessitates the submission of a substantial portfolio of documentation and evidence to the UKVI, it is always recommended to obtain legal advice from a qualified immigration solicitor.

          Frequently Asked Questions

UK Visas and Immigration (UKVI) has adopted the Entry Clearance application scheme (EC). People who are not British citizens but wish to visit or enter the country for a variety of reasons may apply for a visa under this scheme.

This typically entails a face-to-face interview and the collection and recording of applicants' biometric data (fingerprints and photographs) prior to their visit to the UK.

In the vast majority of cases, an EC application can be sent from either the UK or the country where the applicant is a permanent resident.

The UK Tier Visa system is a points-based system that allows applicants to demonstrate their eligibility by scoring a minimum number of points on an evaluation exam. The exam looks at a variety of things, including your age, English language skills, and other factors relevant to the essence of the permit you are applying for. You will be able to include your family and dependents in your application and carry them to the UK if you obtain a visa under this category. Furthermore, you might be able to stay in the country for long enough to qualify for UK settled status or even British citizenship.

The majority of UK visas have an expiration date that is determined by your visa category. ILR and British citizenship are the only immigration statuses that do not need an extension.

It is important to know when your visa will expire and when you must apply your application for an extension. Otherwise, you risk beyond your approval period and facing serious consequences.

To receive a response from the Home Office, you should remember that after you’ve submitted your renewal request, you may have to wait up to eight weeks for a response from the Home Office. Our immigration lawyers will be pleased to assist you if your visa is about to expire and you need legal advice on how to extend it.

You may be eligible to pay a healthcare surcharge, also known as the Immigration Health Surcharge, depending on the immigration status you are applying for (IHS).

When you submit your application form online, you must pay your fee in full. You must provide your IHS reference number on your forms if you are applying by mail.

You can start using the National Health Service as soon as you pay the surcharge and your application is approved (NHS). Additional facilities, such as prescriptions, eye exams, and dental procedures, will require payment.

The Home Office will give you further instructions about your right to appeal its decision along with your refusal letter.

If your right to appeal is denied, you will be given the option of an administrative review.

Your appeal application will only have 28 days to be submitted. However, before you continue, it is important that you understand the reasons for your rejection so that you can avoid making any more mistakes. In most cases, filing a new application is less time consuming and less expensive than appealing the decision of the authorities.

An appeal or administrative review case is often difficult to navigate. As a result, you should seek legal advice from a lawyer.

To learn more about our Appeal package and all of our bespoke immigration programs, give us a call or send us an email.

Overstaying your visa is a criminal offence under section 24 of the Immigration Act of 1971. To put it another way, once your visa expires, you must leave the UK within 30 days unless you have good reason to stay longer.

You will face long-term consequences if you overstay your visa. For example, if you leave the UK voluntarily after your 30-day duration, you might face a one- to a ten-year ban on re-entering the country. The only way to get around the ban is to leave the country on your own dime.

Overstaying your visa will hinder all potential attempts to re-enter and visit the UK. Furthermore, you will never be able to naturalise as a British citizen because you will not be considered of good character in any circumstances.

If you withdraw your application before your biometrics are processed, you may be eligible for a refund in some conditions.

You will need to contact the UKVI if you applied from outside the UK. Only if your application has not yet been approved will you obtain a refund in this situation.

Applications submitted from within the UK may be removed by filling out the required online form. It should be remembered, however, that fee refunds are not available for applications submitted in the UK.

If you are offered a skilled job by a UK-based employer, the case would only be valid if the place is on the Tier 2 Shortage Occupations List. Scientists, engineers, nurses, physicians, and IT specialists are among the jobs on this list.

Before a professional job may be offered to a foreign worker, it must first be advertised for 28 days according to UK law. If a position is on this list, however, your employer will recruit you before the deadline. You can include your family members in your forms if your job offer is legally valid.
