    While there has been a decline in the categories of immigration and asylum cases eligible for Legal Aid under the new rules (April 2013), the following matters, in general, would qualify for any advice, assistance, and/or representation:

    • Cases involving detention and bail; Under the domestic violence rule, applications for Leave to Remain;
    • By victims of human trafficking,  applications for leave;
    • Proceedings before the Special Immigration Appeals Commission.   Deportation and deprivation of citizenship cases where information must be kept confidential for national security reasons are included;
    • several asylum cases and appeals; Under Article 3 of the European Convention on Human Rights, applications for Leave to Remain or settlement as a refugee with humanitarian protection/discretionary leave, i.e. freedom from torture and inhuman and degrading treatment.
    • In limited cases, certain Judicial Review Applications.

    Unfortunately, Legal Aid is no longer available for most non-asylum immigration cases.

    Entry Clearance Visas, such as those for a spouse/partner or family member, are included in this category.
